Background of the case: Dr. Vernon Gray (offended party) had an individual obligation protection strategy with Zurich Insurance Company (Zurich) (litigant). Under this approach, Zurich consented to pay every one of the harms Gray was obligated for coming about because of activities against him for real damage or property harm, and to guard any claims against Gray asserting substantial damage or property harm. The approach prohibited inclusion for "real damage or property harms caused deliberately by or at the heading of the protected." Gray was associated with a fight with John Jones (Gray v. Zurich Insurance Co, 1966).
